These Terms and Conditions (“Terms”) govern your access to, and use of the services provided by Genetics Cryobank, including through our website, mobile communications, and physical branches. By engaging with our services whether as a client, donor, clinic, or website visitor you agree to comply with these Terms.
Services Offered
Genetics Cryobank provides the following ART-compliant services:
- Frozen Sperm Banking (Grades M10–M50)
- Oocyte (Egg) Donor Services
- Sperm Preservation
- Donor Screening and Documentation in accordance with ART Act, 2021
- Nationwide Delivery of Cryogenic Samples to IVF Clinics
All services are offered to eligible individuals and licensed clinics under applicable Indian laws and medical ethics.
Eligibility
For Donors:
- Must meet defined age and health criteria
- Must undergo complete medical, genetic, and psychological evaluations
- Must sign legally compliant donor consent forms
Genetics Cryobank reserves the right to reject any donor or service request that does not meet eligibility or regulatory standards.
Medical Disclaimer
Our services support clinical fertility treatments but do not guarantee pregnancy or clinical outcomes, which depend on several external medical factors.
All information provided online or by staff is for informational purposes only and is not a substitute for professional medical advice or treatment.
Legal & Regulatory Compliance
All donor processes, client interactions, and services strictly adhere to the Assisted Reproductive Technology (Regulation) Act, 2021, and related Indian regulations.
We do not engage in or support any services that violate national bioethical or reproductive laws.
User Responsibilities
a) Clients:
- Must provide accurate, complete, and updated information
- Are responsible for timely renewal of sperm storage to avoid termination or disposal
- Must ensure all submitted documents are signed truthfully
b) Donors:
- Must provide truthful responses during screening
- Must attend scheduled medical appointments
Understand that their identity remains anonymous and they hold no parental rights or responsibilities
Payments
- Payments must be made either in advance or at the time of delivery, based on the nature of the service and internal approval.
- Services such as sample preservation and sperm cryostorage generally require advance payment.
- All services will proceed only after successful payment confirmation.
- Accepted modes of payment include UPI, bank transfer, and other authorized channels.
Sample Handling & Delivery
- Frozen samples are shipped in cryogenic containers filled with liquid nitrogen, ensuring temperature stability during transit
- Genetics Cryobank is not liable for delays caused by third-party logistics or unforeseen events (e.g., strikes, natural disasters, regulatory delays)
- Once delivered and used in treatment, samples cannot be returned or replaced
Privacy & Data Protection
All personal, medical, and genetic data is handled in compliance with our Privacy Policy and the ART regulations. Donor and recipient confidentiality is strictly maintained.
Intellectual Property
All content on our website including text, images, forms, software, and logos is the intellectual property of Genetics Cryobank. Unauthorized copying or commercial use is strictly prohibited without written permission.
Limitation of Liability
Genetics Cryobank is not liable for:
- Clinical outcomes of fertility treatments
- Sample loss due to natural disasters or external factors
- Misuse or mishandling of samples by clients or clinics
- Donor withdrawal before oocyte or sperm retrieval
Our liability is limited to the value of the service rendered.
Modifications
We may update these Terms at any time. All changes will be posted here with a revised effective date. Continued use of our services after updates constitutes acceptance of the revised Terms.
Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes shall fall under the exclusive jurisdiction of the courts located in Maharashtra, Mumbai.
